Text, graphics, and HTML code are protected by US and International Copyright Laws, and may not be copied, reprinted, published, translated, hosted, or otherwise distributed by any means without explicit permission.

While copyright was not an issue historically and therefore wasn’t mentioned in the classical books of Islamic law (Fiqh), contemporary Islamic scholars, like the world-renowned Mufti Taqi Usmani, have confirmed that copyright laws do have a place in Islam, and that it is not permissible to take advantage of the efforts of others by appropriating their work without permission.

Ellavita Clothing, in accordance with the laws of US and international statutes, therefore defends the copyright of all text, graphics, and programming used on this website.

WHY DO WE DEFEND OUR COPYRIGHT?

Firstly, people who take our photographs do so to mislead customers by displaying photos of garments that they aren’t selling. They claim the garments "look similar," but they don’t, because all of our products are exclusively designed and produced by us.

Secondly, customers may be misled into thinking that they are purchasing genuine Ellavita Clothing pieces. Since we make our own GENUINE ELLAVITA CLOTHING, no one else can claim to sell it! We develop our products ourselves with high-quality standards.

Finally, we work very hard to develop this website to provide useful information in the manner in which today's online world demands it. These people are also acting dishonestly by using US and international laws and crucial websites by misrepresenting our brand.

We have rights to our hard work and investments in research and production.

HOW DO WE DEFEND OUR COPYRIGHT?

We take the following measures to defend our copyright:

  • First Step

We request that the copyright violator remove our copyrighted material within a certain period of time. We explain the above-mentioned points in a polite manner, stating that we assume the person concerned made the wrongdoing of their actions unintentionally.

  • Second Step

If the attempt is not successful, we file a DMCA takedown request to the violator's Internet Service Provider informing them that they are hosting a website that is displaying our copyrighted material without permission. This results in the ISP removing the website from the internet. We also inform the hosting provider.

  • Final Step

We take legal counsel and explore legal proceedings against the violator. Ellavita Clothing is extremely reluctant to take legal action against a fellow business. However, when the steps above fail, the violator of our copyright has deliberately taken Ellavita Clothing images, text, and designs, and we are forced to act.

HOW DO WE CATCH COPYRIGHT VIOLATORS?

We simply do a search on the web every few weeks and then go through the websites that link similar catalogs to us. We also hear from concerned customers who have found our photographs on sites that we have not made, and we inform them accordingly.

Our company is in constant communication with law firms and organizations dedicated to catching people who try to misuse our materials. These groups take better action against people who try to steal our work.

WHAT TO DO IF YOU SUSPECT ONE OF OUR PHOTOGRAPHS, LOGOS, OR TEXT HAS BEEN ILLEGALLY TAKEN?

All of our material is timeless, displaying our products with a unique brand. If you suspect someone is using our materials without the permission of Ellavita Clothing and misrepresenting, CONTACT US using the "Online Queries" section. Thank you for your help.
